Welcome to Wicked Kilt. These Terms of Service explain the conditions under which you may browse our website and purchase our books.

By placing an order through our website, you agree to these terms, subject to your statutory consumer rights.

1. About Wicked Kilt

Wicked Kilt is an independent Scottish publishing business offering colouring books, cookbooks and other printed publications.

Wicked Kilt is operated by Ryan Carneson as a sole trader based in Aberdeen, Scotland.

2. Products and Availability

Our books are printed on demand through our printing and fulfilment partner, Bookvault.

We aim to ensure that product descriptions, photographs, specifications and prices are accurate.

Printed colours may vary slightly from digital screen representations. This does not affect your right to receive goods that match their description and meet applicable quality standards.

We reserve the right to correct genuine listing errors and withdraw products from sale. If an error or availability problem affects an order, we will contact you to explain your options, including cancellation and a refund.

3. Pricing and Payment

All prices on our website are displayed in British pounds sterling (GBP).

The total payable amount, including applicable taxes and delivery charges, will be displayed before you place your order.

Retail payments are securely processed through the payment providers available at Shopify checkout.

We do not store your full payment card details.

Your order is subject to payment authorisation and acceptance. We will confirm your order by email.

4. Printing and Delivery

Our books are printed after an order has been placed.

Orders are produced and dispatched through Bookvault or another fulfilment partner where indicated.

Delivery charges and available shipping services are calculated at checkout according to the items ordered and delivery destination.

Estimated delivery times are provided where available. Unless a different period is agreed, we will deliver within 30 days of the order being placed, in accordance with applicable consumer law.

If there is a significant delay or we cannot fulfil your order, we will contact you and explain your available options and legal rights.

Responsibility for goods purchased by consumers generally passes to the customer when the goods are delivered into their physical possession, or to someone they have authorised to receive them.

Please contact us if your order is lost, significantly delayed, damaged or incorrect.

5. Cancellations, Returns and Refunds

UK consumers purchasing standard, non-personalised books online normally have the right to cancel within 14 days of receiving their order.

Printing a standard book on demand does not, by itself, remove this right.

• Damaged or defective items

• Incorrect deliveries

Nothing in these Terms of Service limits your statutory rights under the Consumer Rights Act 2015 or other applicable consumer protection legislation.

6. Wholesale and Trade Purchases

Wicked Kilt welcomes enquiries from bookshops, gift shops, souvenir retailers, visitor attractions and other trade customers.

Our wholesale arrangements currently include:

• A minimum wholesale order of 10 books.

• Mixed-title orders, subject to availability.

• Privately quoted wholesale prices.

• Delivery calculated for the complete order.

• Payment by bank transfer in advance.

• Production and fulfilment arranged after cleared payment.

Wholesale orders are currently handled through direct enquiries and quotations rather than the standard retail checkout.

The specific terms agreed in a wholesale quotation or invoice will apply to that trade order.

Consumer-specific cancellation rights do not generally apply to purchases made by businesses for resale.

7. Intellectual Property

All original books, recipes, illustrations, written content, publishing designs, branding and other materials produced or owned by Wicked Kilt are protected by applicable intellectual property laws.

Purchasing a physical book does not transfer copyright in its contents.

You may use our books for their intended personal purposes, including colouring, reading and following recipes.

Unauthorised commercial reproduction, redistribution or resale of copied content is prohibited unless permitted by law or authorised by the relevant rights holder.

Retailers purchasing genuine physical copies through our wholesale arrangements may resell those copies.

8. Website Use

You agree not to misuse our website, attempt unauthorised access, interfere with its operation or use it for unlawful purposes.

We may update, improve or temporarily suspend website features when reasonably necessary.

9. Personal Information

We handle customer personal information in accordance with our published Privacy Policy and applicable UK data protection legislation.

Order information is shared with relevant service providers, including Shopify, payment processors and fulfilment partners, where necessary to process and deliver purchases.

10. Liability and Consumer Rights

We are responsible for supplying goods in accordance with applicable law.

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for fraud, death or personal injury caused by negligence, or your statutory consumer rights.

We do not exclude liability for foreseeable losses caused by our breach of contract or failure to exercise reasonable care and skill.

11. Changes to These Terms

We may update these Terms of Service to reflect changes in our business, products or legal requirements.

The terms applicable to an order are those in effect when that order is placed, unless a change is required by law or expressly agreed with the customer.

12. Governing Law

These terms are governed by the laws of Scotland, subject to any mandatory consumer protections that apply to you.

Nothing in these terms prevents consumers from exercising rights to bring proceedings in the courts available to them under applicable law.
